Marylin Monroe Photos

Photographer Bert Stern is suing Michael Weiss and Donald Penny over allegations that they are unlawfully holding Stern’s Marylin Monroe images.

Stern hopes that the legal action will force Weiss and Peeny to return seven photographs of Marylin Monroe the images were taken 6 weeks before the star overdosed, they are irreplaceable images and are nudes and semi-nudes of the star Marilyn Monroe, Stern claims the images were stolen from him.

The photos were taken by Bert Stern on an assignment for Vogue magazine in July 1962, the timing of these images added to their value, as not only was the star at the peak of her career but was only weeks before her infamous death. All things in consideration the images are said to be worth in excess of $US100,000 each.

The photos were taken at Los Angeles’ Bel Air Hotel and the series was labeled The Last Sitting as the movie star died shorlty after.Marylin Monroe, famous for films such as Gentlemen Prefer Blondes as well as her extravagant lifestyle and publisised affairs posed in various gently erotic poses. The nudes and semi nudes hinted at erotica but had a playful feel and some were teasing as Monroe posed behind a piece of transparent pink gauzy fabric. Stern recreated these shots earlier this year in February during a photo session with Lindsay Lohan.

Stern, who is based in New York, put forward his claim to the Manhattan State Supreme Court that he lent his treasured photographs to Eros Magazine and were agreed to be returned a few months late. Once these photos were not returned Strand claimed they were stolen.

Stern heard that the photos were being held by Michael Weiss and Donald Penny who contacted him a few months ago offering “to do a deal”. Weiss and Penny returned two of the photos for authentication, but the photographer was told he would have to for the rest.

Stern offered the duo reasonable funds for the return of his own images but the pair were too “greedy”negotiations turned sour and Stern decided to Sue.

The lawsuit includes unlawful possession of his property and unjust enrichment. Stern is asking for a minimum of $US700,000 for the photographs and further $US1 million in punitive damages and legal fees.
